PRIVACY POLICY

The mobile application (the “Rematch Sport App”) and the website (the “Rematch Sport Website”) (together, the “Rematch Sport Service”), which allow users to record short clips of amateur sports competitions and then share them online to promote amateur sports, are made available to you by LA PASSE VIDEO, a simplified joint-stock company (société par actions simplifiée) with share capital of €25,000, registered with the Bordeaux Trade and Companies Register under number 832 876 585, with its registered office at 269 Boulevard du Président Wilson (“La Passe Vidéo”, “we”, “us”, “our”).

This privacy policy describes how we use and protect the personal data of the Service’s Users, the Participants (players, referees, coaches, etc.), and the Spectators of amateur sports competitions whose image is recorded (together, “you”, “your”).

Please note that you may, at any time, request the deletion of your personal data, including your image, by following the procedure described in Article 8.

1. Collection of Personal Data

We do not knowingly collect personal data from minors. If you are under 18 years of age, you are not authorized to use the Service.

We collect personal data in different ways, as described below.

1.1 User Data Collected When Creating an Account on the Service

To use the Rematch Sport App or to comment on or “like” content on the Rematch Sport Website, you must create an account by providing your username, email address, and password.

1.2 User Data Collected When Using the Service

We may also collect other personal data directly from you, in particular when you contact our customer service or when you respond to a survey.

1.3 Image of Participants and Spectators of Sports Competitions

We collect short video clips recorded by Users that may contain the image of Participants and Spectators of sports competitions.

The Service may contain videos of amateur sports competitions involving minors, in particular as players or participants.

Any person appearing in a video, or their legal representative in the case of a minor, may at any time exercise their rights and request the removal of content relating to them, in accordance with the procedures set out in Article 8.

1.4 Data Automatically Collected When Using the Service

When you use the Service, certain data are collected automatically, including:

  • technical data relating to the device used (device type, operating system, app version, language, regional settings);
  • connection and usage data (IP address, connection logs, technical events, interactions with the Service);
  • technical or advertising identifiers, generated in a pseudonymized manner, enabling in particular audience measurement, performance analysis and the detection of malfunctions.

These data are collected in accordance with the choices expressed by the User regarding consent, where consent is required.

2. Our Use of Personal Data

We use the personal data of the Service’s Users, Participants and Spectators of sports competitions for the following purposes:

  • to enable Users to film highlights of amateur matches and share them online in order to provide visibility for amateur competitions.
  • to ensure the proper functioning of the Service (including processing Users’ comments/opinions, enabling us to analyze how the Service is used, contacting Users about the Service, managing requests relating to the right of access, rectification, objection and the handling of personal data after the death of the data subjects, improving the Service and the services we offer, resolving disputes, handling complaints, fixing operational issues, and conducting satisfaction surveys);
  • to send Users, provided they have expressly consented, commercial communications about our products, services and offers.

3. Legal Basis for Processing

We process this personal data on the basis of our legitimate interests, which are as follows:

  • promoting amateur sports by making match videos available online that are not otherwise accessible;

Certains traitements, notamment ceux liés à la mesure d’audience, à l’attribution marketing et à l’utilisation de traceurs ou SDK non strictement nécessaires au fonctionnement du Service, sont fondés sur le consentement de l’Utilisateur.

This consent may be withdrawn at any time from the account settings or via the Website, without affecting the lawfulness of processing carried out prior to such withdrawal.

Geolocation

The use of the geolocation feature on the Rematch Sport App requires your prior and explicit consent. To do so, you must enable, if you wish, the geolocation function directly in your smartphone settings and agree to allow the Rematch Sport App to use it. This feature may be disabled or re-enabled at any time and free of charge.

If you agree to be geolocated, this will allow us to present a list of ongoing matches near you, thereby facilitating your use of the La Passe Vidéo App.

4. Retention Period for Personal Data

We retain a User’s personal data and the videos they have recorded for as long as the User’s account remains active.

Before permanently deleting a User’s personal data and the videos they have recorded, we will send an email to the User offering them the opportunity to download their videos to a device of their choice.

By exception to the above, if a Participant or Spectator requests the deletion of videos in which they appear, we will immediately delete the video without allowing the User to recover it.

5. Recipients of Personal Data and Transfers

We transmit the personal data we collect to service providers who support our business (IT providers, logistics partners), including the Service’s hosting provider.

We do not transfer personal data outside of the European Union.

However, some of our service providers may process or make personal data accessible from countries located outside the European Union, in particular the United States.

These transfers are governed by appropriate safeguards in accordance with Article 46 of Regulation (EU) 2016/679 (GDPR), in particular through the execution of standard contractual clauses adopted by the European Commission and, where applicable, through additional technical and organizational measures designed to ensure an adequate level of protection of personal data.

  • Google Analytics 4 and Google Tag Manager, for audience measurement and analysis of navigation on the Website;
  • AppsFlyer, for advertising attribution and marketing campaign analytics;
  • HubSpot, for customer relationship management, communications and marketing actions;
  • Stripe, for secure payment processing.
  • Microsoft Clarity, for user behavior analysis, session replays and heatmaps.

These service providers act only on our instructions, under contracts that include commitments compliant with the GDPR, particularly with regard to data security and confidentiality.

6. Public Authority

We may be required to disclose personal data to legally authorized bodies and authorities as part of an investigation into illegal activities that may involve our responsibility, your responsibility, or the responsibility of another Service user.

7. Commercial Communications and Opt-Out

We may send administrative emails to Users (emails regarding changes to the operation of the Service, the privacy policy, etc.) and, subject to obtaining their prior consent, emails containing offers, promotional information or newsletters.

Users may opt out of receiving non-administrative emails by contacting us at demande@rematch.fr or by using the unsubscribe link included in the message received.

8. Your Rights

You have the right to access and rectify your data, to object to processing for legitimate reasons, and the right to data portability, limitation of processing, and erasure of your data.

If you wish to exercise these rights, you may send us an email at demande@rematch.fr or write to us at “La Passe Vidéo, 269 Boulevard du Président Wilson, 33200 Bordeaux”, or press the report button located on the videos available on the Rematch Sport Website. You will need to provide proof of identity by sending us a copy of your ID.

Please also note that in the event of non-compliance with your rights, you may lodge a complaint with the CNIL (French Data Protection Authority).

9. Cookies and Other Trackers

10. Third-Party Websites

The Service may contain links to other websites operated by third parties. Please note that this privacy policy applies only to personal data we collect on the Service. We are not responsible for personal data collected, stored and used by third parties on their own websites. We encourage you to carefully read the privacy policy of every website you visit.

11. Security

We have adopted physical, electronic and administrative security measures, including the use of extended firewalls and passwords, to secure access to your personal data. In addition, we limit access to personal data to employees who need to know this information to operate, develop or improve the Service.

12. General Information

This privacy policy may be updated periodically. We will notify you of any substantial changes related to the use of your personal data.
